Welcome to QuizKuma. These Terms and Conditions (“Terms”) govern your access to and use of QuizKuma.com, including our website, applications, learning tools, flashcards, quizzes, study sets, and related services (collectively, the “Services”).

QuizKuma is an online learning platform that enables users to create, organize, study, practice, and share educational materials. By accessing or using the Services, you agree to be bound by these Terms. If you do not agree, you must not use the Services.

1. Acceptance of Terms

By accessing, registering for, or using QuizKuma, you confirm that you have read, understood, and agreed to these Terms and our Privacy Policy.

If you use QuizKuma on behalf of an organization, school, or other entity, you represent that you have the authority to accept these Terms on its behalf.

We may update these Terms from time to time. When material changes are made, we will take reasonable steps to notify users through the website or other appropriate means. The updated Terms will take effect on the date stated in the revised document. Your continued use of the Services after the effective date constitutes acceptance of the updated Terms, to the extent permitted by applicable law.

2. Eligibility and Accounts

You must be legally capable of entering into a binding agreement under applicable law to accept these Terms.

If you are below the age required to independently consent to the use of the Services in your jurisdiction, you may use QuizKuma only with the involvement and appropriate consent of a parent or legal guardian, where permitted by applicable law.

You agree to:

• Provide accurate and current registration information.
• Keep your login credentials secure.
• Maintain the security of your account.
• Notify us promptly if you suspect unauthorized access to your account.
• Accept responsibility for activities conducted through your account, except where applicable law provides otherwise.
• Avoid creating accounts through deceptive means or using another person's identity without authorization.

You must not sell, transfer, or improperly share your account with another person.

We may suspend or restrict accounts where we reasonably believe that account activity violates these Terms, compromises security, or creates a risk to QuizKuma or other users.

3. Description of Services

QuizKuma provides tools that may include:

• Creating and managing flashcards and study sets.
• Adding terms, definitions, descriptions, images, and audio.
• Studying through interactive flashcards.
• Practising through multiple-choice, matching, spelling, and true-or-false exercises.
• Tracking practice results and learning progress.
• Organizing study sets into folders.
• Searching for and accessing publicly available study materials.
• Sharing educational content with other users.
• Accessing free or paid features, where available.

We may introduce, modify, suspend, or discontinue features as the platform develops. We will take reasonable steps to communicate material changes where appropriate and as required by law.

Some features may require an account, a subscription, or compliance with additional conditions.

4. User-Generated Content

QuizKuma allows users to create, upload, store, and share content, including flashcards, study sets, text, descriptions, images, audio, and other educational materials (“User Content”).

You retain ownership of User Content to the extent that you own the applicable rights.

By submitting User Content to QuizKuma, you grant QuizKuma a non-exclusive, worldwide, royalty-free licence to host, store, reproduce, process, display, distribute, and make that content available as reasonably necessary to operate, maintain, secure, promote, and improve the Services.

For content you designate as public, this licence includes making the content available to other users, displaying it on public study pages, and enabling search engines to index eligible public pages.

For private content, we will use it in accordance with your settings, our Privacy Policy, and applicable law. This licence does not authorize us to make private study sets publicly available contrary to your settings.

The licence continues for as long as reasonably necessary to provide the Services, comply with legal obligations, resolve disputes, enforce our agreements, and maintain legitimate backups. Following deletion, residual copies may remain temporarily in backups or records where technically or legally necessary.

You represent and warrant that:

• You own User Content or have all necessary rights and permissions to submit and share it.
• Your User Content does not infringe intellectual property, privacy, publicity, or other rights.
• Your User Content complies with applicable laws and these Terms.
• You have obtained any necessary permissions for uploaded images, recordings, or personal information.

You are responsible for maintaining your own copies of important User Content.

5. Public and Private Study Sets

When creating a study set, you may be able to designate it as public or private.

Public study sets

Public study sets may be viewed, searched, shared, and used by other users. Eligible public pages may appear in search engine results. Other users may learn from or practise with public content within the functionality provided by QuizKuma.

You should not include confidential, sensitive, or personal information in public study sets.

Private study sets

Private study sets are intended to be accessible only to you and other persons expressly authorized through available features. We will apply reasonable technical and organizational measures to protect private content, but no online service can guarantee absolute security.

You are responsible for checking the visibility setting before publishing a study set. If you change a public study set to private, access through public pages may be restricted, although cached copies or previously shared information may remain outside our control.

We reserve the right to remove or restrict access to content that violates these Terms or applicable law.

6. Acceptable Use

You agree to use QuizKuma lawfully and responsibly.

You must not:

• Upload or share unlawful, fraudulent, defamatory, abusive, hateful, or otherwise prohibited content.
• Upload malware, viruses, malicious code, or files designed to compromise systems.
• Infringe copyrights, trademarks, patents, trade secrets, or other rights.
• Upload another person's personal information, images, or recordings without a lawful basis or required permission.
• Harass, threaten, impersonate, exploit, or deceive other users.
• Use the Services to cheat, facilitate academic misconduct, or misrepresent qualifications or credentials.
• Attempt to gain unauthorized access to accounts, databases, systems, or private content.
• Circumvent authentication, usage limits, subscription restrictions, or security controls.
• Scrape, harvest, copy, or systematically extract content or data without authorization.
• Use automated tools to overload, disrupt, or abuse the Services.
• Reverse engineer or interfere with the Services except to the extent such restrictions are prohibited by law.
• Use QuizKuma to distribute spam, conduct unauthorized advertising, or promote illegal activities.
• Use the Services in a way that interferes with other users' enjoyment or the platform's operation.

We may investigate suspected violations and take proportionate action, including removing content, limiting functionality, suspending accounts, or terminating access.

7. Intellectual Property

QuizKuma and its original software, branding, logos, designs, interfaces, illustrations, mascots, documentation, and other platform materials are owned by or licensed to QuizKuma and are protected by applicable intellectual property laws.

Except as expressly permitted by these Terms, you may not reproduce, modify, distribute, sell, publicly display, or create derivative works from our protected materials without prior written permission.

You may use QuizKuma to create and study educational materials in accordance with these Terms.

The QuizKuma name, branding, and mascot may not be used in a way that implies endorsement, affiliation, or authorization without our permission.

User Content remains subject to the ownership and licence provisions in Section 4.

8. Copyright Complaints and Content Removal

We respect intellectual property rights and expect users to do the same.

If you believe that content available through QuizKuma infringes your copyright or other intellectual property rights, please contact info@quizkuma.com.

Your notice should include sufficient information to identify the material, explain the alleged infringement, identify the rights involved, and provide a means for us to contact you. You should also provide any supporting information reasonably necessary to assess the complaint.

We may remove or restrict access to disputed material, request additional information, and take appropriate action against repeat infringers.

Submitting a complaint does not guarantee removal. We may consider counter-notices or other relevant information where appropriate and permitted by law.

9. Images, Audio, and Third-Party Content

QuizKuma may provide stock images, pronunciation audio, embedded resources, links, or other third-party materials.

Such materials may be subject to separate licences, usage conditions, or intellectual property rights. Their availability through QuizKuma does not automatically grant you unrestricted rights to download, redistribute, sell, or reuse them outside the Services.

You must comply with applicable licence conditions when using stock images or third-party media.

If you upload your own images or audio, you are responsible for ensuring that you have the necessary rights and permissions.

We do not guarantee the continued availability, accuracy, suitability, or quality of third-party materials.

10. Educational Information and Learning Outcomes

QuizKuma is an educational and practice platform. Its materials are provided for general learning and informational purposes.

We do not guarantee that any study set, flashcard, explanation, translation, pronunciation, quiz, or other educational material is accurate, complete, current, or suitable for a particular purpose.

User-generated content may contain mistakes, omissions, misleading statements, or inappropriate material. Users should independently verify important information, particularly when preparing for examinations, professional certifications, or other high-stakes assessments.

QuizKuma does not guarantee examination results, language proficiency, academic performance, professional qualifications, or any particular learning outcome.

QuizKuma is not affiliated with or endorsed by examination providers, educational institutions, or certification organizations unless expressly stated.

11. Free Services, Paid Features, and Subscriptions

QuizKuma may offer free features and paid subscriptions or other paid services.

Paid features may include unlimited practice, advertising removal, expanded media functionality, advanced statistics, or other benefits described at the time of purchase.

The available features, pricing, usage limits, billing periods, and subscription conditions will be presented before you complete a purchase.

We may change free features or introduce new paid features, subject to applicable law and any existing contractual commitments.

You agree to pay the fees applicable to any paid service you purchase. Unless otherwise stated, prices and charges are displayed in the currency specified at checkout.

12. Billing, Renewal, and Cancellation

If a subscription automatically renews, the renewal frequency, applicable price, and cancellation terms will be disclosed before purchase.

You authorize the applicable payment provider to charge the payment method you select for amounts due under your subscription.

You may cancel an eligible subscription through the account or billing controls provided by QuizKuma or the applicable payment provider. Cancellation generally prevents future renewals but does not automatically refund charges already paid.

Unless otherwise specified, paid access continues until the end of the current paid billing period after cancellation.

If a payment fails, we may retry the payment, request an updated payment method, or suspend paid features until payment is resolved.

Refunds are governed by applicable law and any refund terms presented at the time of purchase. Nothing in these Terms excludes mandatory consumer rights or statutory refund entitlements.

13. Advertising and Promotions

QuizKuma may display advertisements, sponsored content, or promotional materials to support free services.

Advertisements may be delivered by third-party advertising providers, which may use cookies or similar technologies subject to applicable law and our Privacy Policy.

QuizKuma does not necessarily endorse products or services advertised by third parties. Your interactions or transactions with advertisers are between you and the relevant third party unless expressly stated otherwise.

Where an advertising-free subscription is offered, its scope and conditions will be described before purchase.

14. Privacy and Data Protection

Your use of QuizKuma is also governed by our Privacy Policy, which explains how personal information is collected, used, disclosed, retained, and protected.

We may process information necessary to provide accounts, save study sets, record practice results, maintain security, provide customer support, process payments, and improve the Services.

You are responsible for ensuring that information you submit, especially information about other people, may lawfully be provided to QuizKuma.

We will handle personal information in accordance with our Privacy Policy and applicable privacy and data protection laws.

15. Third-Party Services

QuizKuma may rely on third-party services for hosting, authentication, storage, analytics, payment processing, advertising, or other functions.

Your use of certain third-party services may be subject to separate terms and privacy policies.

We are not responsible for the independent acts, omissions, policies, availability, or content of third-party services, except to the extent liability cannot lawfully be excluded.

16. Availability and Changes to the Services

We aim to keep QuizKuma available and functioning reliably, but we do not guarantee uninterrupted, secure, or error-free operation.

The Services may be unavailable because of maintenance, upgrades, technical issues, security incidents, third-party outages, or circumstances beyond our reasonable control.

We may modify, suspend, or discontinue parts of the Services when reasonably necessary for operational, legal, security, or business reasons. Where appropriate, we will take reasonable steps to minimize disruption and notify affected users of material changes.

We are not responsible for loss caused by interruptions to the extent permitted by applicable law.

17. Account Suspension and Termination

You may stop using QuizKuma at any time and may request account deletion through available account controls or by contacting info@quizkuma.com.

We may suspend, restrict, or terminate your access if:

• You materially violate these Terms.
• Your activity presents a security, legal, or operational risk.
• We are required to do so by law or a lawful authority.
• Your account is involved in fraud, abuse, or unauthorized activity.
• We discontinue the Services or a material part of them.

Where reasonably practicable and appropriate, we will provide notice and an opportunity to address the issue. We may act immediately where necessary to protect users, comply with law, or prevent serious harm.

Upon termination, your right to use the affected Services ends. Provisions that by their nature should survive termination, including intellectual property, liability, indemnification, and dispute-related provisions, will continue to apply.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, QuizKuma is provided on an “as is” and “as available” basis.

We disclaim warranties and conditions not expressly provided in these Terms, including implied warranties or conditions of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted availability, to the extent those exclusions are permitted by law.

We do not warrant that the Services will be free of errors, security vulnerabilities, harmful components, or inaccurate content.

Nothing in this section limits any warranty, guarantee, or consumer right that cannot lawfully be excluded.

19. Limitation of Liability

To the maximum extent permitted by applicable law, QuizKuma and its operators, affiliates, service providers, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, business opportunities, goodwill, data, or anticipated savings arising from or related to your use of, or inability to use, the Services.

To the maximum extent permitted by applicable law, our total aggregate liability for claims arising from or relating to the Services or these Terms will not exceed the greater of the amount you paid directly to QuizKuma for the Services during the twelve months preceding the event giving rise to the claim and CAD $100.

These limitations apply regardless of the legal theory of the claim, including contract, tort, negligence, or otherwise, and even if we have been advised of the possibility of such damages.

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law, including applicable liability for fraud, wilful misconduct, or other non-excludable liability.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless QuizKuma and its operators, affiliates, and representatives from third-party claims, liabilities, damages, losses, and reasonable expenses arising directly from your unlawful conduct, your material violation of these Terms, or your infringement of another person's rights through User Content you submit.

This obligation does not apply to the extent a claim results from our own negligence, wilful misconduct, breach of law, or other conduct for which liability cannot lawfully be transferred to you.

We will provide reasonable notice of an indemnifiable claim where practicable and may participate in its defence.

21. Dispute Resolution

If you have a concern or dispute regarding QuizKuma, please contact info@quizkuma.com first so that we can attempt to resolve it informally.

Nothing in these Terms prevents you from bringing a complaint to a relevant consumer protection authority, privacy regulator, or other competent body, or from exercising any mandatory rights available under applicable law.

Subject to mandatory legal requirements, disputes will be governed by the laws applicable to the operator of QuizKuma and the relevant Services, without applying conflict-of-law rules that would require a different governing law.

Where applicable law grants you the right to bring proceedings in your place of residence, nothing in these Terms is intended to remove that right.

22. International Use

QuizKuma may be accessed from different countries. You are responsible for complying with laws applicable to your use of the Services.

We do not represent that all features, content, or services are available or appropriate in every jurisdiction.

Access to the Services may be restricted where required by law or where providing the Services would create legal or regulatory obligations that we cannot reasonably meet.

23. Changes to These Terms

We may revise these Terms to reflect changes in our Services, business practices, legal obligations, or security requirements.

The revised Terms will be published on QuizKuma.com with an updated effective date. Where required by law, we will obtain additional consent or provide advance notice before material changes take effect.

If you do not agree to revised Terms, you must stop using the affected Services before the revised Terms apply to you, subject to any applicable rights and obligations.

24. General Provisions

Entire agreement. These Terms and the Privacy Policy, together with any applicable additional terms presented at purchase or when using specific features, constitute the agreement governing your use of QuizKuma.

Severability. If a provision is found invalid or unenforceable, it will be limited or removed only to the extent necessary, and the remaining provisions will continue in effect.

No waiver. A failure to enforce a provision does not waive the right to enforce it later.

Assignment. You may not assign your rights or obligations under these Terms without our prior consent. We may assign or transfer our rights and obligations as part of a business reorganization, merger, acquisition, or transfer of assets, subject to applicable law.

Force majeure. We will not be responsible for delays or failures caused by circumstances beyond our reasonable control, to the extent permitted by law.

No agency. These Terms do not create a partnership, joint venture, employment, or agency relationship between you and QuizKuma.

Electronic communications. You agree that notices and communications provided electronically may satisfy applicable legal requirements for written communications, where permitted by law.
